General Terms and Conditions (GTC) for the Use of the “SafePrompt” Software
1. These General Terms and Conditions (GTC) govern the contractual relationship between the provider of the “SafePrompt” software (hereinafter the “Provider”) and the users (hereinafter the “User”) who install and use the software.
2. By using the software, the User fully accepts these GTC. Anyone who uses the software agrees to be bound by these terms.

The “SafePrompt” software is a tool for heuristic anonymization of documents (e.g., plain text, PDF) as well as for managing text prompts. Anonymization is performed using heuristic methods. Complete or error-free anonymization and comprehensive protection against data leaks or misuse cannot be guaranteed.

The software is provided “as is” and “without warranty.” Further services (e.g., future updates, specific functionalities, or support) are only included if expressly agreed upon.
4. Distribution and Payment via Paddle
The paid versions are sold through Paddle as the Merchant of Record. Payment processing and delivery of the software are handled by Paddle. Any claims arising from the payment transaction are subject to Paddle’s terms and conditions.
5. 30-Day Return Policy for Paid Versions
A 30-day return policy applies to all paid versions (Premium Monthly and Premium Unlimited). Within this period, the User may withdraw from the purchase without giving any reason and will receive a refund of the amount paid, provided this is not contradicted by statutory provisions or restricted by Paddle’s policies.
6. No Entitlement to Support
The User is not entitled to support unless expressly agreed upon (e.g., in separate maintenance agreements).
7. Changes to Prices and Services
The Provider reserves the right to adjust the prices for the paid license models (Premium Monthly, Premium Unlimited) as well as to modify or expand individual services or functionalities.
8. Right of Withdrawal for Consumers

Statutory Right of Withdrawal If the User is a consumer (i.e., a natural person concluding the contract predominantly for purposes not related to their trade, business, or self-employment), they have a statutory right of withdrawal when entering into a paid contract for the “SafePrompt” software. The withdrawal period is 14 days from the date of concluding the contract.

The User must clearly state their decision to withdraw from the contract.
3. Consequences of Withdrawal If the User withdraws from this contract, the Provider shall refund all payments received from the User without delay and no later than 14 days from the day on which the Provider receives the withdrawal declaration. The Provider will use the same payment method that the User used for the original transaction, unless expressly agreed otherwise.
4. Expiration of the Right of Withdrawal for Digital Content The right of withdrawal expires if the Provider begins performing the contract with the User’s express consent before the withdrawal period ends, and the User has simultaneously acknowledged that they lose their right of withdrawal by agreeing to the start of performance.

The User is solely responsible for the use of the software and for verifying that the anonymizations performed meet data protection requirements.

The User must carefully review anonymized documents before sharing or further processing them with third parties.
3. Intended Use
The software may only be used for its intended internal purpose. Use in safety-critical environments or for processing particularly sensitive data is at the User’s own risk.

The Provider makes no warranty as to the completeness, accuracy, or timeliness of the anonymized content. In particular, any liability for damages arising directly or indirectly from the use of the software is expressly excluded, to the extent permitted by law.

Where mandatory statutory provisions apply, liability is limited to the legally prescribed scope. Liability for damages caused intentionally by the Provider remains unaffected.

The User is responsible for taking all necessary measures to protect their data.
2. Local Processing and API Requests
The “SafePrompt” software operates locally for its core functions (anonymization, text management).
3. Type of Data Processed
Where data is collected, it mainly involves technical information (e.g., device or license data). Generally, it does not allow direct personal identification. The Provider does not store or process personal content unless necessary for payment transactions, license management, or to comply with legal requirements.
4. Security Recommendations
The Provider recommends using up-to-date security software and performing regular data backups. The Provider is not liable for unintended disclosure or compromise of data resulting from improper use.

The “SafePrompt” software, including all underlying source code, designs, graphics, text, images, videos, databases, and other content, is protected by copyright.
2. Restrictions on Use
The User is expressly prohibited from copying, distributing, modifying, decompiling, or otherwise using the software or parts thereof without the Provider’s explicit written consent—unless necessary for the proper use of the software.
3. Legal Consequences of Violations
Any unauthorized use, reproduction, or distribution of the software constitutes a copyright infringement and may lead to legal consequences.

Should any provision of these GTC be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that most closely reflects its economic purpose.
2. Changes to the GTC
The Provider reserves the right to change these GTC at any time. Any changes will be communicated to the User in an appropriate manner. Continued use of the software after the changes take effect constitutes acceptance of the amended terms, unless an explicit right to object is provided.
3. Place of Jurisdiction and Applicable Law
These GTC and all disputes arising from or in connection with the software shall be governed exclusively by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction, to the extent legally permissible, is the Provider’s registered office.
By installing and using the “SafePrompt” software, the User confirms that they have read and understood these GTC and agree to be bound by their contents.
